As a high-quality web-hosting provider to hundreds of customers, CENTAURHOSTING is required to meet a range of legal and ethical responsibilities. In the interests of its customers and of the service provided to them, CENTAURHOSTING also requires that they observe certain mutually protective and beneficial standards of behavior. These are outlined in the sections below.

Please read these "Terms of Service" carefully before registering for the Services. If you do not accept these terms, you may not access or otherwise use these services. Registration for or continued use of the Web Hosting facilities offered by CENTAURHOSTING indicates your acknowledgement that you have read and accepted the "Terms of Service" and that you agree to be bound by them.

The following policies are intended for ALL clients. Violation of these may result in termination / suspension of the account without prior notice.

The following constitute examples of "unacceptable use" of CENTAURHOSTING's services, which will result in suspension, or termination of the customer's account.

E-mail

Unacceptable affronts to netiquette and unacceptable activities include but are not limited to spamming (sending unsolicited advertising to those with which the customer has no existing business relationship, posting off-topic advertising in newsgroups); spoofing (using a return email address which is not the valid reply address of the sender) or sending an email message which does not contain enough information to enable the recipient to identify the party who is really sending the message; passive spamming (promoting a web site hosted by CENTAURHOSTING by spamming from some other source), trolling (posting controversial messages in newsgroups to generate responses), mail bombing (inundating a user with email without any serious intent to correspond), generating a higher volume of outgoing mail than a normal user (over 10% of available system resources), and subscribing someone else to an electronic mailing list without that person's permission. A message is considered unsolicited if it is posted in violation of a newsgroup charter or sent to a recipient who has not requested the message. Making an email address available to the public does not constitute a request to receive messages. Distribution of mass emailing programs is also prohibited. All recipients on a mailing list must have personally subscribed. Mailing lists may not be used to distribute unsolicited email. Any customer repeatedly "mail bombed" or that attracts such behavior will be asked to leave and the services will be terminated. CENTAURHOSTING may disclose the usernames of accounts responsible for forged email messages to system administrators or users requesting the information.

Age

The client must be 18 years of age to obtain our service.

Abuse of the legal rights of others

Examples of unacceptable activities in this regard include posting private information about a person without their consent, infringing intellectual property rights, defaming a person or business, and knowingly making available code, which will have a deleterious effect on third party computers. CENTAURHOSTING supports free speech on the Internet, and will not suspend or cancel a customer's account simply because it disagrees with the views expressed by the customer. Where there are allegations that a customer's online activity has violated the legal rights of a third party, CENTAURHOSTING will not substitute itself for a court of law in deciding tort claims raised by the third party.

Abuse of the law

CENTAURHOSTING's services may be used for lawful purposes only. Illegality includes but is not limited to: drug dealing; attempting without authorization to access a computer system; pirating (distributing copyrighted material in violation of copyright law, specifically MP3s, MPEG's, ROMs, and ROM emulators); gambling; schemes to defraud; trafficking in obscene material; sending a message or having content that is obscene, lewd, lascivious, filthy, or indecent with intent to annoy, abuse, threaten, or harass another person; threatening bodily harm or damage to individuals or groups; stalking; or violating other laws. Linking to illegal material is also prohibited. Anything violating Indian Law will be considered as abuse of our services and the person indulging in the same will be considered totally liable for his acts. On finding this we will discontinue the services immediately and inform the same to the Law enforcement agencies to take care of the situation. This will not arise any liability on CENTAURHOSTING or any of its associates, partners or proprietor.

CENTAURHOSTING reserves the right to check system files, email, and other data on our servers for illegal content and materials, or for other reasons deemed necessary.

Pornography

Pornography and sex-related merchandising, or links to such material, even if legal, is NOT an acceptable use of CENTAURHOSTING's servers.

Abuse of System Security

Client is prohibited from utilizing the Services to compromise the security of system resources or accounts on servers at CENTAURHOSTING or at any site. Use or distribution of tools designed for compromising security or containing viruses or Trojans is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools.

If client is involved in violations of system security, CENTAURHOSTING reserves the right to release all usernames of users involved in such violations to system administrators at other sites in order to assist them in resolving security incidents. CENTAURHOSTING will also fully cooperate with Law enforcement authorities in investigating suspected lawbreakers.

Abuse of CENTAURHOSTING's Server Resources

Abuse of server resources is any use of CENTAURHOSTING servers' resources that disrupts the normal use of its servers or services for others.

Examples of system abuse include running excessive numbers of processes or consuming excessive amounts of CPU time, memory or disk space. Running programs in the background on CENTAURHOSTING's servers without CENTAURHOSTING's prior written authorization, or running chat rooms, Internet Relay Chat, IRC bots, Greeting Card sites, software downloading sites and the like are not acceptable uses of CENTAURHOSTING's servers. Further, any usage of ten percent (10%) or more of our system resources is an undue burden on our system and is unacceptable. If your usage ever exceeds ten percent (10%) of system resources, your account may be terminated immediately and without prior notice. In addition any domain that exceeds ten gigabytes of bandwidth traffic in a month may be terminated without prior notice. Usage of scripts or other utilities to direct pointed domain names to subdirectories is not permitted and is grounds for termination of the account.

Misuse of materials

Materials in the public domain (e.g., images, text, and programs) may be downloaded or uploaded using the Services. Client may also re-distribute materials in the public domain. Clients assume all risks regarding the determination of whether the material is in the public domain.

Clients are prohibited from storing, distributing or transmitting any unlawful material through the Services. Examples of unlawful material include, but are not limited to, threats of physical harm, child pornography, and copyrighted, trademarked and other proprietary material used without proper authorization. You may not post, upload or otherwise distribute copyrighted material on CENTAURHOSTING servers without the consent of the copyright holder.

Hacking / Cracking

The following examples of unacceptable behavior are non-exclusive, and are provided for guidance purposes. If you are unsure if your actions will be a violation of our policies please contact our .

Server broadcast messages or any message sent on an intrusive basis to any directly or indirectly attached network. Attempt to circumvent any user authentication or security of host, network, or account. Accessing data not intended for user. Probing the security of any network. Spawning dozens of processes. Port scans, ping floods, packet spoofing, forging router information, Denial of Service attacks, sniffers, flooding, spoofing, ping bombing, smurfs, winnuke, land, teardrop. Promulgation of viruses. IRC bots such as eggdrop or BitchX.

Any activity, whether or not the intrusion results in the corruption or loss of data, will be investigated and proper action taken. The presence of any of these programs, whether or not run, will result in action against the user including suspension or termination.

CENTAURHOSTING reserves the right to report illegal activities to any and all regulatory, administrative, and/or governmental authorities for prosecution.

Though CENTAURHOSTING takes full precautions against data losses and takes regular backups of the data on it's servers, it will not be responsible for any user's loss of data due to any reason whatsoever. No guarantees are made of any kind, either expressed or implied, as to the integrity of the backups. Backups are made for server restoration purposes only. It is the clients' responsibility to maintain local copies of their web content and any information.

CENTAURHOSTING would not be liable to replace data under any circumstances and strongly advises it's users to maintain regularly updated backups of their data. If loss of data occurs due to an error of CENTAURHOSTING, CENTAURHOSTING will attempt to recover the data for no charge to the client but does not guarantee its recovery.

CENTAURHOSTING maintains control and any ownership of any and all I.P. numbers and addresses that may be assigned to the client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.

The client is responsible for all activity originating from the account / web site , with or without their knowledge or consent. Client agrees to use the Services only for lawful purposes, in compliance with all applicable laws. When CENTAURHOSTING becomes aware of possible violations, then CENTAURHOSTING, in its sole discretion, will determine what action will be taken in response to a violation on a case-by-case basis.

The client is responsible for securing their username/password. The client assumes responsibility for all material on their site that may be put on by a third party (such as the usage of Free For All links pages). Use of CENTAURHOSTING's service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The following examples are offered: Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability. CGI-Scripts: requires knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, C, Shell scripts, permissions, etc. Mail: a use of mail clients to receive and send mail, etc. The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of CENTAURHOSTING to provide this knowledge or support outside matter specific to CENTAURHOSTING's servers.

Clients approved and authorized as CENTAURHOSTING resellers are allowed to resell the storage and transfer services provided by CENTAURHOSTING as provided for in its standard product offering. Reseller agrees to handle and is responsible for all third-party client's content, support, set-up, maintenance and billing. Reseller agrees to having the necessary additional knowledge and skill level required. Reseller also agrees that they are responsible for all payments for accounts brought on by them under the reseller program.

Recurring Billing:

While we attempt to send renewal invoices well in advance, it is the clients responsibility to ensure that they make the payment before the expiry of their hosting period. In the event we do not receive the payment before the expiry of hosting period, the account will be deactivated and any accounts under that account plan will also be deactivated.

All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and bill for traffic exceeded.

CENTAURHOSTING reserves the right to refuse, cancel, suspend or discontinue service to anyone at CENTAURHOSTING's sole discretion.

CENTAURHOSTING shall be the sole arbiter of what is and is not a violation of these policies. CENTAURHOSTING may deny access to all or part of the service without notice if a client engages in any conduct or activities that CENTAURHOSTING in its sole discretion believes violate CENTAURHOSTING policies. CENTAURHOSTING shall have no responsibility to notify any third-party providers of services, merchandise, or information, nor any responsibility for any consequences resulting from such discontinuance or lack of notification. CENTAURHOSTING reserves the right to refuse to post or to remove any information or materials, in whole or in part, that, in its sole discretion, are unacceptable, undesirable, or in violation of this agreement.

CENTAURHOSTING reserves the right to delete all content and files upon termination and to withhold any pre-paid funds for any site removed for violations of these policies. If you sign up for an account and do not follow our terms, No refunds will be given.

CENTAURHOSTING shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from CENTAURHOSTING's servers going off-line or being unavailable for any reason whatsoever. Further, CENTAURHOSTING shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of CENTAURHOSTING's servers.

Client further agrees to indemnify, defend, and hold harmless CENTAURHOSTING from any and all liability, penalties, losses, damages, costs, expenses, attorneys' fees, causes of action or claims asserted against CENTAURHOSTING, its agents, its customers, officers and employees, that may arise or result from any Service provided or performed or agreed to be performed or any Product sold by customer, it's agents, employees or assigns.

BY ACCEPTING THIS AGREEMENT, YOU ALSO AGREE TO WAIVE AND HOLD CENTAURHOSTING HARMLESS FROM ANY CLAIMS RELATING TO ANY ACTION TAKEN BY CENTAURHOSTING AS PART OF ITS INVESTIGATION OF A SUSPECTED VIOLATION OF THIS AGREEMENT OR AS A RESULT OF ITS CONCLUSION THAT A VIOLATION OF THIS AGREEMENT HAS OCCURRED. THIS MEANS THAT YOU CANNOT SUE OR RECOVER ANY DAMAGES WHATSOEVER FROM CENTAURHOSTING AS A RESULT OF CENTAURHOSTING'S DECISION TO: REMOVE MATERIAL FROM ITS SERVERS, WARN YOU, SUSPEND OR TERMINATE YOUR ACCOUNT, OR TAKE ANY OTHER ACTION DURING THE INVESTIGATION OF A SUSPECTED VIOLATION OR AS A RESULT OF CENTAURHOSTING's CONCLUSION THAT A VIOLATION HAS OCCURRED. THIS WAIVER APPLIES TO ALL VIOLATIONS DESCRIBED IN THIS AGREEMENT.

CENTAURHOSTING reserves the right to change these policies without prior notice or warning. Non-enforcement of any part of the Policies does not constitute consent.
